1. How to use the web site
The use of the www.barcelonasuite.com web site is limited to private users and commercial use will not be allowed. The user does not have the right to copy the site nor portions of it, neither to present it, to publish it, to expose it, to change it or to create a site based on it without the express permission of BARCELONASUITE. The right to use the web site, to seek information or to make a single reservation is granted to persons 18 years of age or older, private individuals, legal staff, or representatives of institutions or businesses. We reserve the right to change the web site or portions of it and its content whenever we consider it necessary. Although we strive with all our effort to assure the accuracy of the information presented on the web site, it contains information and material that depends on outside persons and/or institutions. For that reason we are not responsible for such information.
2. Reservations
BARCELONASUITE accepts requests to reserve lodgings in Barcelona through the form, correctly filled and sent, found on the web site and through telephone calls. All questions pertaining to confirmations, details of services or cancellations must be asked via e-mail, fax, telephone or in writing. With the request of a reservation the user of the site agrees to conclude a contract according to these conditions of use and he will be called from this moment client. Once confirmation of the reservation is sent by barcelonasuite com (in the name of BARCELONASUITE) by e-mail, fax or post, a valid contract will be drawn up. The client will have to verify that all the information in the confirmation is correct and to notify BARCELONASUITE of any corrections within three days. If the client does not notify us of anything within this period means that the client accepts the reservation just as it was sent. We reserve the right to correct errors due to math or spelling. The client is solely responsible for all obligations, which could result from the contract and will be responsible for all the persons included in his/her reservation.
- Lodgings (Apartments, shared flats):
- Lodging availability is updated constantly, day and night, 365 days a year. If, however, you send a reservation request for lodging in Barcelona to BARCELONASUITE and it is no longer available we will respond as soon as possible with proposals of any equivalent alternatives available. If you decide not to accept any of these, all your personal data, including credit card details, will be eliminated immediately and any bank transfers will be returned.
- Specific conditions for reservations:
- In case a reservation is made with credit card payment, confirmation will be immediate. For apartments and shared flats other methods of payment may be selected. In that case, the reservation is done as soon as BARCELONASUITE receives the prepayment in its bank account, or the cash, or, in case of a bank transfer, the fax verifying it. Confirmation of reservations paid for by bank transfer can take from 1 to 3 business days. The texts of all reservation contracts are filed and the status of a reservation can be consulted on our web site at any time. For security reasons the specific data of requests cannot be consulted via the Internet, as they are treated as confidential in accordance with our data security rules.
3. Rates and prices
All the rates are quoted in euros (€) and always will be confirmed when BARCELONASUITE bills the client. Before making a reservation on-line you will be able to see the total price broken down, including VAT. Currency exchange equivalences are updated several times a day. It is possible, but not probable, that prices will vary very slightly.
- Additional lodging costs:
- Generally our rental rates do not include additional expenses such as the telephone, unless specifically mentioned on the web site. These additional expenses should be paid to the property's contact person. Please make yourself aware of all types of possible additional expenses and look for related information on the web site. Lodging prices do not include: transportation between the airport and lodging, excursions or other personal expenses, additional charges for rooms, food or low occupation, and services and amenities the apartment owner may charge for services such as mini-bus, sunbeds, sauna, tennis court, etc...
4. Requesting service
Upon making a reservation the user authorizes BARCELONASUITE to charge his/her credit card (or other credit facility as agreed) for all purchases of services requested by him/her via this site. The user agrees not to report as lost or stolen any credit card which he/she has used in conjunction with payment to BARCELONASUITE for services which he/she does not have good reason to believe is, in fact, lost or stolen. The user further agrees not to report as unauthorised any charge for services which he/she has, in fact, requested. The user agrees that any such false reporting of a lost or stolen credit card or of unauthorised charges shall render him/her liable to BARCELONASUITE. The liability for liquidated damages specified in this paragraph shall not limit any other liability he/she may have for breach(es) of any other terms, conditions and warranties set forth in this Agreement.
5. Payment system
- Lodging (apartment, shared flat):
- BARCELONASUITE will send confirmation of lodging, as soon as we receive prepayment by bank transfer (or a fax as proof of the transfer), or after having charged the credit card with the quantity of the prepayment. The remaining sum of the total of the value of the reservation must be paid directly to the contact person upon arrival. We will indicate the method of payment in each lodging and before invoicing a payment. In some cases, generally in reservations for periods of more than a month, BARCELONASUITE reserves the right to charge the client the first month of rent in advance, before the date of the arrival.
- Methods of payment:
- We accept credit card payments (Visa, EuroCard/Mastercard and American Express) and bank transfers. The client must pay all bank charges that occur. If you choose to pay by bank transfer, please, indicate the name of the person for whom the reservation is in the documents of the transfer. It is very important to send us the receipt of the bank transfer (with the name of the person for whom the reservation was made, passport number, complete address, telephone number and email address) by fax. We can only reserve lodging after receiving this fax.
6. Credit card and security
BARCELONASUITE takes every precaution to protect our users information. Users personal information is protected both on-line and off-line. When users enters personal information (such as a credit card number) into our forms, that information is encrypted and protected with the best software in the industry – SSL and PGP. While on a secure page, such as our order form, the “lock” icon at the bottom of Web browsers such as Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked, or open, when simply surfing. While we use SSL software to protect sensitive information on-line and PGP to protect it during data transmission, we also do everything in our power to protect user-information off-line. All user information, not just the sensitive information mentioned above, is restricted to our offices. All employees are kept up-to-date on our Privacy Policy. If payment is made through our automatic payment system then the credit card processing is done by "La Caixa" OFFICE 0941, Muntaner Street 33-39, Postal Code 08011, Barcelona, Spain. NIF (Fiscal Identification Number) G.58.89999-8.
7. Confirming reservations
Our instant booking system is available for Barcelona apartments reservations. In these cases, a booking confirmation will be sent in the moment the reservation is made if paying with a credit card and correctly completing all the fields on our form that required for processing the payment. All other reservations or requests will be attended to within 24 hours, except during weekends.
8. Cancellations
- Lodging (apartments, shared flat)
- All cancellations must be made in writing by e-mail or fax. Please note that our cancellation charges depend on the amount of advance notice given prior to the arrival date at the property reserved. This cancellation policy applies to all amounts already credited and confirmed by the client.
- Cancellation Policy:
- - - 76 days or more before arrival: Refund of all payments made
  - - Between 46 and 75 days before arrival: Refund 50% of any payments made
  - - 45 days or less before arrival: Nothing refunded.
- We, therefore, recommend that you obtain travel insurance that provides cover for this should you have to cancel your travel plans.
- This is the cancellation policy for all properties unless specifically stated in the description of the property itself. In such cases the cancellation policy for the specific property reserved will be applied.
9. Force Majeure
The client is not released from the responsibility of payment due to personal circumstances or force majeur including, but not limited to, war, strikes or natural catastrophes.
10. Check-in / Check-out
- Apartments, shared flats:
- If you have reserved accommodation go directly to the address indicated in the accommodation confirmation that BARCELONASUITE sent you. The properties contact person will give you the keys, and handle the check in and check out . Check in time is from 12 noon on the date of your arrival. In case of delay the contact person must be advised immediately. Check out time must be before 11:00 am. In case of a delay in the occupation of the accommodation, or in case of an unanticipated departure, there will not be any discount made to the total rental price.
- On arrival to the accommodation, please give a copy of your identity papers to the contact person for the legally required registration. The contact person has the right to refuse admittance to individuals who do not present identity papers. It is not permitted to stay in the accommodation with persons other than those mentioned on the booking form or those who are with you on arrival. Any change of persons during the stay is strictly forbidden, except when permission has been asked and granted prior to arrival. Furthermore, it is not permitted to occupy the accommodation with more people than mentioned in the booking confirmation. In such cases BARCELONASUITE has the right to ask you to immediately vacate the premises.
11. Before and during your stay
BARCELONASUITE and its supplier are not liable for damages or losses that may result from travel to any particular destination. It is your responsibility to ensure you have the relevant visa for the country you are visiting, plus any inoculations required.
12. Pets
Normally it is not permitted to bring pets to the accommodation In certain cases (seeing-eye-dogs, pets for children with psychological disabilities, etc.) it is possible that BARCELONASUITE may give special permission. Please inquire prior to making a reservation if you may bring along the animal.
13. Privacy Policy
BARCELONASUITE wants to demonstrate its commitment to your privacy. If you are interested in learning more about what personal information is being gathered by our site, who is collecting the information, how the information will be used or with whom the information will be shared with, please consult our Privacy Policy.
14. Claims Lodgings
- (apartments, shared flats):
- In case of claims against the accommodation you must immediately inform the contact person. If not, you will loose all rights of compensation. If the reasons for the claim have not been dealt with in an appropriate period of time you must inform BARCELONASUITE. Any request for compensation must be presented in writing to BARCELONASUITE within one month. Requests made after this period of time will unfortunately not be eligible.
15. Responsibility
BARCELONASUITE and its employees are not responsible for: de:
- - errors, omissions, or misspelled words
- - misrepresentation by third parties
- - content of external links you will find on our website.
BARCELONASUITE is responsible for exercising the diligence of a respectable business for the conscientious preparation, the careful monitoring and selection of the service providers and the respectable contribution of the agreed services taking into consideration local and national customs.
16. Withdrawal on the part of BARCELONASUITE
BARCELONASUITE may withdraw from the contract without any consequence, if the client regardless of a warning by BARCELONASUITE disturbs the peace or behaves contrary to the terms of the agreement in such a degree that the immediate annulment of the contract is justified. If we terminate for the reasons specified above, then our claim to the entire rent remains; we must however take into account the value of saved expenditures as well as the advantages which we may attain from another reservation of the apartment.
17. Notice
Any communiqué directed to BARCELONASUITE should be sent to info@barcelonasuite.com or to our fax number (+34) 972 357 262 (Spain) during the office hours. You as the client should inform BARCELONASUITE of any changes such as the expiration date of any credit card used in connection with the services; changes in home or billing address; etc. BARCELONASUITE will provide you with copies of billing records documenting charges for use of the services upon request.
18. Salvatori clause
If a rule of this agreement should be declared illegal by a responsible court, that does not affect the validity of the other regulations. If a rule of this agreement is ineffective only in a section, then the other sections keep their validity. The invalid or unenforceable condition will be deemed as supplanted by an enforceable and valid form conveying the same meaning. Any dispute will be governed by the non-exclusive law and jurisdiction of the Spanish courts.
19. Area of jurisdiction
Barcelona, Spain is agreed upon as the exclusive area of jurisdiction for suits against BARCELONASUITE.
20. Trademarks
BARCELONASUITE and other graphics, logos, and names that appear in this web site are registered trademarks of BARCELONASUITE or of their respective suppliers. These registered trademarks may not be used with any product or service that is not be offered by BARCELONASUITE or by its respective suppliers, and/or in any manner that can cause confusion amongst our clients, and/or in any manner that disparages or discredits the business BARCELONASUITE.
